This Privacy Policy explains the types of information we may collect, how we may collect and use it, the circumstances in which it may be disclosed, the choices and rights that may be available to you, and the measures we use to protect it. This Privacy Policy applies to information collected through Greyhaven’s website and related online communications. It may also apply to information collected in connection with inquiries about Greyhaven’s real estate acquisition, operating, asset management, property management, and related services.

1. Information We May Collect

Information submitted through the website may help Greyhaven understand your inquiry, real estate objectives, or potential interest in Greyhaven’s services. Submitting information does not create an attorney-client, accountant-client, investment advisory, financial advisory, fiduciary, agency, partnership, joint venture, or other professional relationship. Greyhaven does not use information submitted through the website to independently determine your tax liability, eligibility for Real Estate Professional Status, material participation, deductibility of losses, availability of depreciation deductions, Section 1031 qualification, or any other taxpayer-specific legal or tax determination.

Disclosure to a third party does not necessarily mean that Greyhaven controls that third party’s subsequent privacy practices.

6. Independent Professional Advisers

At your request or when reasonably necessary to facilitate a transaction, Greyhaven may communicate with your independently retained attorney, accountant, CPA, tax professional, financial adviser, lender, broker, or another professional adviser. 7. Sale of Personal Information

Greyhaven does not sell personal information for monetary consideration. Greyhaven also does not intend to operate as a data broker or to derive revenue from selling lists of website visitors, prospective investors, clients, or their personal information. If Greyhaven later implements advertising technologies that constitute a “sale,” “sharing,” or targeted advertising under an applicable state privacy statute, the Privacy Policy and website consent and opt-out mechanisms should be revised before those technologies are activated.

8. Targeted Advertising and Analytics

Greyhaven may use third-party analytics services to understand how visitors interact with the website. If Greyhaven uses advertising cookies, social media pixels, cross-site tracking technology, or other technologies that constitute targeted advertising or the sale or sharing of personal information under applicable law, Greyhaven will provide any notice and opt-out mechanism required by applicable law.

9. Cookies

Cookies are small data files stored on a device when a user visits a website. Greyhaven may use cookies necessary to operate and secure the website and may also use analytics cookies to understand website usage. Depending on the technologies deployed on the website, users may be able to manage nonessential cookies through a website consent tool or through browser settings. Disabling certain cookies may affect website functionality.

10. Third Party Websites and Services

The Greyhaven website may include links to websites or services operated by third parties. Greyhaven does not control or assume responsibility for the privacy, security, content, or data-handling practices of third-party websites or services. Visitors should review the applicable privacy policies of third parties before submitting personal information to them.

11. Data Security

Greyhaven uses reasonable administrative, technical, and physical safeguards appropriate to the nature of the information maintained to protect personal information against unauthorized access, acquisition, disclosure, alteration, destruction, or misuse. No electronic system, Internet transmission, email system, database, or storage environment can be guaranteed to be completely secure. Users therefore should not transmit highly sensitive information through ordinary email or unsecured website forms.

12. Data Retention

Greyhaven retains personal information only for as long as reasonably necessary for the purposes for which it was collected, or as required for legitimate business, contractual, legal, accounting, tax, regulatory, recordkeeping, dispute resolution, or security purposes. Different categories of information may be retained for different periods. Information associated with an actual real estate transaction, contractual relationship, investment, property management engagement, or legal obligation may be retained longer than information associated solely with a preliminary website inquiry.

13. Consumer Privacy Rights

Depending on your state of residence and whether an applicable privacy statute applies to Greyhaven or the processing activity, you may have certain rights regarding your personal information. Those rights may include the right to:

  • confirm whether Greyhaven processes your personal information;
  • access certain personal information;
  • request deletion of certain personal information;
  • obtain a portable copy of certain information;
  • correct inaccurate personal information where applicable;
  • opt out of the sale of personal information where applicable;
  • opt out of targeted advertising where applicable; and
  • exercise applicable rights without unlawful discrimination or retaliation.

These rights are subject to statutory limitations, exceptions, verification requirements, and applicability thresholds.

14. Exercising Privacy Rights

A person seeking to exercise a privacy right may contact Greyhaven at:

Greyhaven West, LLC
51 W Center St. Suite 166 Orem, UT 84058
Email: privacy@greyhavenwest.com
Online Request Form: Contact Us

Greyhaven may request information reasonably necessary to verify the identity and authority of the person making the request. Greyhaven will respond to verified requests in accordance with applicable law.

15. Appeals

If applicable law provides a right to appeal Greyhaven’s decision on a consumer privacy request, the individual may submit an appeal using the contact information above and identifying it as a “Privacy Request Appeal.” Greyhaven will process appeals in accordance with applicable law.

16. Other State Privacy Laws

If Greyhaven becomes subject to the California Consumer Privacy Act, as amended, California residents may have additional rights, including rights to access, delete, correct, and to the sale or sharing of personal information, to the use of sensitive personal information, and to nondiscrimination. Residents of other states may have privacy rights under applicable state law. Greyhaven will honor legally applicable privacy rights in accordance with the requirements and limitations of the law governing the specific request. Nothing in this Privacy Policy is intended to create rights beyond those provided by applicable law or by Greyhaven’s express contractual obligations.

17. Children’s Privacy

Greyhaven’s website and services are intended for adults and businesses interested in real estate ownership, investment, acquisition, operations, or property management. The website is not intended for children under 13 years of age, and Greyhaven does not knowingly solicit personal information from children under 13 through the website. If Greyhaven learns that information has been collected from a child in violation of applicable law, Greyhaven will take appropriate steps to delete that information.

18. Financial Information and Financial Privacy Laws

Greyhaven may receive financial information in connection with real estate acquisitions, financing, investor qualification, or other transactions. The receipt of financial information does not, by itself, mean that Greyhaven is a “financial institution” under the Gramm-Leach-Bliley Act or other financial privacy statutes. If Greyhaven undertakes activities that bring a Greyhaven entity within the scope of a financial privacy statute, Greyhaven will provide any additional notices and safeguards required by that law. This reservation is preferable to stating on the website that Greyhaven is presently subject to a regulatory regime that may not apply.

19. Business Transfers

Personal information may be disclosed or transferred in connection with a merger, acquisition, financing, restructuring, reorganization, sale of assets, change of control, dissolution, or similar business transaction involving Greyhaven or an affiliated entity. Any recipient will remain subject to applicable law governing the transferred information.

20. Legal Compliance and Protection of Rights

Greyhaven may preserve, use, or disclose personal information when reasonably believed necessary to:

  • comply with laws, regulations, subpoenas, court orders, governmental requests, or legal processes;
  • respond to governmental or regulatory authorities;
  • investigate suspected fraud, misconduct, security incidents, or violations of agreements;
  • protect the rights, property, safety, or security of Greyhaven, its clients, website users, or others;
  • establish, exercise, or defend legal claims; or
  • otherwise comply with legal obligations.

21. Email and Marketing Communications

If you provide your email address or other contact information, Greyhaven may communicate with you regarding your inquiry, Greyhaven services, real estate matters, educational information, or other matters reasonably related to your relationship with Greyhaven. Where required by law, marketing communications will include an appropriate method to unsubscribe. Unsubscribing from marketing communications does not prevent Greyhaven from sending transactional, contractual, legal, security, or service-related communications that are reasonably necessary.

22. Do Not Track and Global Privacy Signals

Certain browsers permit users to transmit “Do Not Track” signals. Because no single universally applicable technical standard governs all such signals, Greyhaven’s response will depend on the website technologies in use and applicable law. Where applicable law requires Greyhaven to recognize a legally effective universal opt-out mechanism or similar privacy preference signal, Greyhaven will process that signal as required by law.

23. Changes to This Privacy Policy

Greyhaven may revise this Privacy Policy from time to time to reflect changes to its website, technology, business practices, services, legal obligations, or data processing activities. When material changes occur, Greyhaven will update the effective date at the top of this Privacy Policy and provide any additional notice required by applicable law. Visitors should periodically review this Privacy Policy for updates.
